DABBLE WEBSITE TERMS OF SERVICE

Welcome to Dabble (the “Platform”), which is provided by PT Studio Teknologi Kreatif or one of its affiliates (“we” or “Dabble”), a company with its registered address at Citra Lake Sawangan Ruko Blok A 03 - 19, Kelurahan Kedaung, Kecamatan Sawangan, Depok 16511 Jawa Barat, Indonesia (collectively such entities will be referred to as “Dabble”, “we” or “us”). and other related online services (collectively, "Service(s)") to you subject to the following Terms of Service ("TOS"). You can review the most current version of the TOS at any time at: http://www.dabble.ac/tos. In addition, when using the Services, you shall be subject to any posted guidelines, policies, rules or terms applicable to such Services, which may be posted from time to time. All such guidelines, policies, rules or terms (including, without limitation, the Dabble Public Data Policy) are hereby incorporated by reference. Dabble may also offer other services that are governed by these or different terms of service.

 

THIS AGREEMENT IS A LEGAL AGREEMENT BETWEEN YOU AND DABBLE AND GOVERNS YOUR USE OF THE SERVICES, INCLUDING ANY SUCCESSOR SERVICES. BY USING THE SERVICES YOU ARE INDICATING THAT YOU HAVE READ AND AGREE TO THESE TOS AND THE DABBLE PRIVACY STATEMENT ("PRIVACY STATEMENT") AND, IF APPLICABLE, YOUR MASTER SERVICES AGREEMENT, END USER LICENSE AGREEMENTS OR OTHER USE TERMS ("USER TERMS''), AND ANY OTHER RELATED TERMS AND CONDITIONS LOCATED ON DABBLE’S WEBSITES OR IN THE SERVICES, ALL OF WHICH ARE INCORPORATED HEREIN BY THIS REFERENCE. IF YOU DO NOT AGREE TO THE FOREGOING, DO NOT USE THE SERVICES, DO NOT PROCEED. In the event any of the terms of these TOS conflict with the Privacy Policy or applicable User Terms, the terms of the applicable User Terms or Privacy Policy shall govern as to the conflicting terms. DESCRIPTION OF SERVICE

Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including new releases, shall be subject to these or other applicable TOS. You also understand and acknowledge that Dabble may modify, terminate, suspend, or otherwise adjust any and all functions, features, options, utilities, tools or other aspects of the Service at any time without prior notice to you. Dabble may make available to you versions of the Service or its parts that constitute or include demo, experimental, evaluation, not for resale, preview, in-development, limited availability or other limited access versions (“Limited Versions”). Limited Versions are provided solely for informative purposes. Dabble makes no commitments with respect to Limited Versions, including any commitment to continue any Limited Version or to convert any Limited Version into a product offering. You are responsible for obtaining access to the Service, and that access may involve third-party fees (such as Internet service provider or airtime charges). In addition, you must provide and are responsible for all equipment necessary to access the Service.

 

You acknowledge and agree that the Service, any Dabble proprietary software (“Dabble Software”) and any other software provided in connection with the Service contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content (as defined below) contained or information presented to you through the Service is or may be protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly permitted by applicable law or authorized by Dabble, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Dabble Software or other software or materials, in-whole or in-part.

 

Using the Service does not give you ownership of any intellectual property rights to the Service, including any Content, Dabble Software or Limited Version that you may access. You may not use Content from the Service unless you obtain permission from Dabble or its owner, or unless you are otherwise permitted by law.

 

The names Dabble, Dabble, all logos and product and service names are or may be trademarks of Dabble or its affiliates (the "Dabble Marks"). Except as solely enabled by any link as provided by Dabble, you agree not to display or use in any manner the Dabble Marks without prior written consent.

 

By submitting ideas, suggestions, documents, requests, recommendations, corrections, proposals or other feedback ("Contributions") to Dabble or its affiliates, you grant to Dabble and its affiliates a worldwide, perpetual, irrevocable, royalty-free license to use, distribute, disclose and make and incorporate into any of its software, services or offerings any Contributions. Further, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) neither Dabble nor any of its affiliates are under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) Dabble and its affiliates shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide without any payment, attribution or other obligation; (d) Dabble or its affiliates may have something similar to the Contributions already under consideration or in development; and (e) you are not entitled to any compensation or reimbursement of any kind from Dabble or any of its affiliates under any circumstances.

 

YOUR USE OF THE SERVICE

Dabble does not claim ownership of Content you submit or that you make available for inclusion on the Service. However, with respect to Content you submit or make available for inclusion on publicly accessible areas of the Service, you grant to Dabble and all users of the Service a worldwide, royalty-free and non-exclusive, perpetual, irrevocable and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such Content (in whole or in part) and to incorporate such Content into other works in any format or medium now known or later developed.

 

Additionally, with respect to Content you submit or make available for inclusion on publicly accessible areas of the Services, you represent and warrant that: (a) you have the right to grant such license and make such Content available to Dabble and its licensees, including users of the Service; (b) none of the Content you provide contains any data or information that is confidential, non-public, owned by or otherwise proprietary to a third party, not in the public domain or otherwise restricted or protected from use by any individual, entity or other party for any use by a third party; and (c) neither the delivery to nor use by Dabble or its licensees, including users of the Service, of such content shall violate or infringe the rights of any third party.

 

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not Dabble or any of its affiliates, are entirely responsible for all Content that you upload, download, post, email, transmit or otherwise make available or use via the Service. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable.

 

You agree to not use the Service to:

 

a. upload, post, email, transmit or otherwise make available any Content that:

violates applicable law, including securities laws;

violates the Acceptable Use and External Facing Services Policy;

contains any patient, medical or other protected health information regulated by the Health Insurance Portability and Accountability Act (“HIPAA”), as amended and supplemented) or any similar federal or state laws, rules or regulations;

contains any payment card information;

infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party or use, modify or combine the Content in any manner, with any other material, in any fashion that infringes the Rights of any person;

you do not solely have the right to make available under applicable law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); or

otherwise may create liability or damages to Dabble or its affiliates;

b. impersonate any person or entity, including, but not limited to, a Dabble official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;

c. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form or solicitation, except in those areas of the Service that are specially and specifically designated for solicitation;

d. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

e. interfere with or disrupt the Service or servers or networks connected to the Service;

f. provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;

g. "stalk" or otherwise harass another; and/or

h. collect or store personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs a through g above.

 

You acknowledge that Dabble may or may not pre-screen Content, but that Dabble shall have the right (but not the obligation) to remove Content from the Service that Dabble determines, in its discretion, may create liability or damages to Dabble, in accordance with the Dabble Public Public Data Policy. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. You acknowledge that (a) Dabble is not a Business Associate, as such term is defined in HIPAA, and that the Service is not HIPAA compliant, and (b) neither Dabble nor the Service is compliant with the Payment Card Industry Data Security Standards. In this regard, you acknowledge that the Content is made available to you without any warranties by Dabble of any kind, and that you may not rely on any Content made available through the Service.

 

You acknowledge, consent and agree that Dabble may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any Content violates the rights of third parties; (d) respond to your requests for customer service; or (e) protect the rights, property or personal safety of Dabble, its users and the public.

 

You understand that the technical processing and transmission of the Service, including your Content, may involve: (a) transmissions over various networks, and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

 

You understand Dabble may offer an option for certain users of the Services to set a flag on their profile to indicate availability for a contract-for-hire engagement with other users. However, Dabble does not require or set any commercial terms between users that are introduced through the Services. Without limiting the foregoing, a user's personal statement of availability on the Services does not imply any endorsement by Dabble or any of its affiliates. Users are not our employees or contractors of Dabble or any of its affiliates.

 

You understand that the Service, Dabble Software and any other software embodied within the Service may include security components that permit digital materials to be protected, and that use of these materials is subject to usage rules set by Dabble and/or content providers who provide such materials to the Service. You may not attempt to override or circumvent any digital rights management technology or usage rules embedded into the Service. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on the Service, in whole or in part, is strictly prohibited.

 

The Service may include functionality to provide access to products, services, information, data, content and other materials made available by or on behalf of third parties, including third party connectors, accelerators, extensions or software applications made available through the Dabble Exchange (collectively, “Third Party Materials”) or allow for the routing or transmission of Third Party Materials, including via links. By using such functionality, you are directing Dabble to access, route and transmit to you the applicable Third Party Materials. Your installation or other use of Third Party Materials may result in the transmission of your information, data, content or other materials outside of your or Dabble’s systems, or otherwise result in third party access to, or use of, your information, data, content or other materials. Third Party Materials are not part of the Services provided by Dabble under these TOS. Dabble does not control, has no obligation to monitor, and will have no responsibility or liability for any Third Party Materials. Dabble makes no representation or warranty regarding any Third Party Materials or any information, content, data or other materials made available through any Third Party Materials. Dabble may block or disable access to any Third Party Materials (in whole or part) through the Services at any time. In addition, the availability of any Third Party Materials through the Dabble Exchange or any other Services does not imply Dabble’s endorsement of, or affiliation with, any provider of such Third Party Materials. Your use of Third Party Materials is subject to any additional terms, conditions and policies applicable to such Third Party Materials (such as terms of service or privacy policies of the providers of such Third Party Materials) or applicable to the Dabble Exchange.

 

The Service may contain or be provided with components which are licensed from third parties (“Third Party Code”), including components subject to the terms and conditions of “open source” software licenses (“Open Source Software”). Open Source Software may be identified in a list of the Open Source Software provided to you upon written request. To the extent required by the license that accompanies the Open Source Software, the terms of such license will apply in lieu of the terms of this TOS with respect to such Open Source Software, including, without limitation, any provisions governing access to source code, modification or reverse engineering.

 

DABBLE EXPRESSLY DISCLAIMS ANY AND ALL REPRESENTATIONS OR WARRANTIES RELATING TO ANY THIRD PARTY MATERIALS. YOU WILL LOOK SOLELY TO THE THIRD PARTY PROVIDER OF THE THIRD PARTY MATERIALS FOR ANY WARRANTY RELATED ISSUES OR OTHER CLAIMS RELATED THERETO. OTHERWISE, YOUR USE OF THIRD PARTY MATERIALS IS AT YOUR OWN RISK. DABBLE WILL HAVE NO LIABILITY OR OTHER OBLIGATION OF ANY KIND ARISING OUT OF OR RELATED TO ANY THIRD PARTY MATERIALS OR THE USE OR INABILITY TO USE ANY THIRD PARTY MATERIALS. THE DISCLAIMERS, LIMITATIONS AND OTHER TERMS OF THESE TOS APPLICABLE TO THIRD PARTY MATERIALS WILL APPLY NOTWITHSTANDING ANY HOSTING OR OTHER SERVICES PROVIDED BY DABBLE TO THE THIRD PARTY RELATED TO ANY SUCH THIRD PARTY MATERIALS.

 

You acknowledge that Dabble may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that Content will be retained by the Service, the maximum size of any or all Content files, the maximum disk space that will be allotted on Dabble's servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time, and/or any other condition of the Service. You agree that Dabble has no responsibility or liability for the deletion or failure to store any Content, messages and other communications or other materials or Content maintained or transmitted by the Service.

 

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT: (A) YOUR USE OF THE SERVICE, INCLUDING ANY PRODUCTS, SERVICES, INFORMATION, DATA, CONTENT OR OTHER MATERIALS OBTAINED BY YOU THROUGH THE SERVICE, IS AT YOUR SOLE RISK, THE SERVICE, INCLUDING ANY PRODUCTS, SERVICES, INFORMATION, DATA, CONTENT OR OTHER MATERIALS OBTAINED BY YOU THROUGH THE SERVICE, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND DABBLE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT; (B) DABBLE AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS MAKE NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, DATA, CONTENT, INFORMATION OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (v) ANY ERRORS IN THE SERVICE WILL BE CORRECTED; (C) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF ANY SUCH MATERIAL; AND (D) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM DABBLE OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS. YOU MAY HAVE OTHER STATUTORY RIGHTS. HOWEVER, TO THE FULL EXTENT PERMITTED BY LAW, THE DURATION OF STATUTORILY REQUIRED WARRANTIES, IF ANY, SHALL BE LIMITED TO THE MINIMUM PERIOD ALLOWED BY LAW.

 

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT Dabble AND ITS AFFILIATES AND THEIR OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE, INCLUDING ANY PRODUCTS, SERVICES, INFORMATION, DATA, CONTENT OR OTHER MATERIALS OBTAINED BY YOU THROUGH THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH, FROM OR AS A RESULT OF THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS IN THIS PARAGRAPH MAY NOT APPLY TO YOU.

 

INDEMNIFICATION

You agree to indemnify and hold Dabble and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of: (a) Content you submit, post, transmit or otherwise make available through the Service; (b) your use of the Service; (c) your connection to the Service; (d) your violation of the TOS; (e) your violation of any third party’s rights; or (f) your use or involvement with a contract for hire engagement.

 

TERMINATION

You agree that Dabble may, under any circumstances and without prior notice, immediately terminate your Dabble account, and access to the Service and/or any and all Content, Limited Versions or materials. Cause for such termination shall include, but not be limited to: (a) breaches or violations of the TOS or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Service (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, (g) engagement by you in fraudulent or illegal activities, and/or (h) nonpayment of any fees owed by you in connection with the Services. Dabble may also terminate this Agreement, your Dabble account, access to the Service and/or any and all Content or materials for any reason or no reason whatsoever. Termination of your Dabble account includes: (a) removal of access to all offerings within the Service, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring of further use of the Service. Further, you agree that all terminations shall be made in Dabble's sole discretion and that Dabble shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the Service or Content, including any Limited Versions.

 

GENERAL

The TOS constitutes the entire agreement between you and Dabble concerning your use of the Service, superseding any prior agreements between you and Dabble with respect to the Service. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other Dabble services or Dabble Software, affiliate services, third-party content or third-party software. The TOS and the relationship between you and Dabble shall be governed by the laws of Republic Indonesia without regard to its conflict of law provisions. You and Dabble agree to submit to the personal and exclusive jurisdiction of the courts located within the city of DIY Jakarta, Indonesia. The failure of Dabble to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. The section titles in the TOS are for convenience only and have no legal or contractual effect.

 

AMENDMENTS

This TOS is subject to occasional revision, and if we make any substantial changes, we may notify you by sending you an e-mail to the last e-mail address you provided to us (if any) and/or by prominently posting notice of the changes on our site. Any changes to this TOS will be effective no later than thirty (30) calendar days following our posting of notice of the changes on our Site. Continued use of our Service following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.

 

YOUR REGISTRATION OBLIGATIONS

In consideration of your use of the Service, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the Republic Indonesia or other applicable jurisdiction. In order to access or use certain Services, you may be required to provide certain information about yourself ("Registration Data") as part of the registration process for the Service, or as part of your continued use of the Services. You also agree to: (a) provide true, accurate, current and complete Registration Data as prompted or requested by the Service and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. You understand and agree that the Service may include certain communications from Dabble, such as service announcements and administrative messages, and that you may not be able to opt out of receiving them. If you provide any information that is untrue, inaccurate, not current or incomplete, or Dabble has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Dabble has the right to suspend or terminate your account, prevent your access to any or all portion of the Services and or Content (or other users' access to your Content) and refuse any and all current or future use of the Service (or any portion thereof) or Content. You certify that you are at least 18 years old; if you are not, you may not register for or use the Service.

 

ACCOUNT, PASSWORD AND SECURITY

As part of your use of the Service, you may receive a password and account designation upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to: (a) immediately notify Dabble of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Dabble cannot and will not be liable for any loss or damage arising from your failure to properly safeguard your account or password. You have sole responsibility for adequate protection and backup of Content of any type that you upload to, download from or otherwise create or use with, the Service, and/or equipment you use in connection with the Service.

 

CHARGED OFFERINGS AND FEES

The Service may be available to you with or without charge. Access to certain features, functions, and/or full or partial portions of the Service may require payment. You may also be provided "trial", "demo", "beta" or other Limited Versions of the Service and/or its parts with or without charge. In addition to any fees required to access certain features, capabilities, functions or services offered through or by the Service ("Charged Offerings"), you are responsible for paying all applicable taxes (including, but not limited to those we are not required to collect) and for all third party hardware, software, service and/or other costs you may incur in order to access the Service and your account. Neither these TOS nor your account entitle you to any subsequent releases of the Services, nor to any for-pay features, products, capabilities, features, upgrades or services offered, distributed or made available through the Service without paying applicable charges or except as otherwise expressly and explicitly provided by Dabble. All or some of the Service may need to be downloaded to your computer and/or accessed online. You must have authorized and separate Service access for each account you wish it to be enabled for and, where applicable, you must download and install any necessary software on each machine on which you wish to use and access the Service.

 

Converting an account and/or specific Service version or offering, including but not limited to trial or limited functionality rights offerings, to an enhanced account and/or fee-based version of the Service or other paid account, version or other Charged Offering may result in the loss of access to the information or other data associated with your use of the free or non-paid version of the Service. Dabble reserves the right to charge a fee for the Service or any of its features, products, capabilities, functions, upgrades or services at any time.

 

You may terminate your account at any time. You will not receive full or partial refunds for subscription periods that you have purchased. Provision of the services:

 

The Personal Data we collect to provide our products and services may include information you have made publicly available online (such as when using social media sites) or that is published by third parties and contains information about you (such as news articles). For a select number of services, we collect this Personal Data from partners who may receive this data when you visit or use their services or through the third parties they work with.

In addition, the Personal Data we collect to provide our products and services may include location information from third parties, which helps us offer features like identity management and multi-factor authentication.

Advertising: The Personal Data we collect from other sources for the purposes of tailored advertising includes identifiers, professional or employment-related information, education information, commercial information, visual information, internet activity information, and inferences about preferences and behaviors. We, collect this from third party providers of business contact information, including mailing addresses, job titles, email addresses, phone numbers, intent data (or user behavior data), IP addresses, social media profiles, LinkedIn URLs and custom profiles for purposes of targeted advertising, delivering relevant email content, event promotion and profiling, determining eligibility and verifying contact information. This helps us update, expand, and analyze our records, identify new customers, and create more tailored advertising to provide services that may be of interest to you.

Another individual at your organization who may provide us with your personal information, which may include Personal Data and special categories of Personal Data, to the extent you consent to providing it and sharing it, for the purposes of obtaining services and assessing our goals related to encouraging diversity within our vendors; and 

Platforms such as GitHub to manage code check-ins and pull requests. If you participate in an open-source or community development project, we may associate your code repository username with your community account so we can inform you of program changes that are important to your participation or relate to additional security requirements.

Only where necessary for security purposes, we may collect information that is publicly available online (such as accessible through search engines or public social media sites), as well as images, physical descriptions and other pertinent information necessary to address a credible security threat to our employees, events or premises.

4. What Device and Usage Data do we process?

 

We use common information-gathering tools, such as tools for collecting data, cookies, web beacons, pixels, and similar technologies to collect information that may contain Personal Data as you navigate our websites, our services, or interact with emails we have sent to you.

In addition, we may use aggregated Usage Data for other internal business purposes, such as to identify additional customer opportunities and to ensure that we are meeting the demands of our customers and their users. Social Media Features are either hosted by each respective platform or hosted directly on our website. Dabble also allows you to log in to certain of our websites using sign-in services. These services authenticate your identity and provide you the option to share certain Personal Data from these services with us such as your name and email address to pre-populate our sign-up form.

4.6 Telephony log information

Legal obligation or our legitimate interest in protecting against misuse or abuse of our websites or services, protecting personal property or safety, pursuing remedies available to us and limiting our damages, complying with judicial proceedings, court orders or legal processes, responding to lawful requests, or for auditing purposes

 

If we need to collect and process Personal Data by law, or under a contract we have entered into with you, and you fail to provide the required Personal Data when requested, we may not be able to perform our contract with you.

 

6. Who do we share Personal Data with?

We may share your Personal Data as follows:

Service providers: With our contracted service providers, who provide services such as IT and system administration and hosting, credit card processing, research and analytics, marketing, events planning, customer support and data enrichment for the purposes and pursuant to the legal bases described above in Section 5. Contracted service providers may also deliver artificial intelligence and generative artificial intelligence capabilities to analyze data, determine trends, make predictions and create AI-generated responses or other content for the purposes and pursuant to the legal bases described above in Section 5; 

Dabble affiliates: With affiliates within the Dabble corporate group and companies that we acquire in the future after they are made part of the Dabble corporate group, to the extent such sharing of data is necessary to fulfill a request you have submitted via our websites or for customer support, marketing, technical operations, event registration and account management purposes; 

Event sponsors: If you attend an event or webinar organized by us, or download or access an asset on our website, we may share your Personal Data with sponsors of the event. If required by applicable law, you may consent to such sharing via the registration form or by allowing your attendee badge to be scanned at a sponsor booth. In these circumstances, your information will be subject to the sponsors’ privacy statements. If you do not wish for your information to be shared, you may choose to not opt-in via event/webinar registration or elect to not have your badge scanned, or you can opt-out in accordance with Section 10 below;

Partners: With specific partners that offer supplementary services to those provided by Dabble, such as partners that offer sustainability resources, or that resell Dabble services, to the extent you consent to such sharing (where required by applicable law);

Customers with whom you are affiliated and the applicable partner responsible for access to your services: If you use our services as an authorized user, we may share your Personal Data with your affiliated customer and/or the applicable partner responsible for your access to the services to the extent this is necessary for verifying accounts and activity, investigating suspicious activity, or enforcing our terms and policies; 

Contest and promotion sponsors: With sponsors of contests or promotions for which you register in order to fulfill the contest or promotion;

Third party networks and websites: With third-party social media networks, advertising networks and websites, so that Dabble can market and advertise on third party platforms and websites;

Third party AppExchange partners: Specifically in relation to the AppExchange website, if you choose to interact with or use third-party tools, we may share your Personal Data with our third party partners who may contact you regarding their products or services in accordance with law or our contractual commitments;

Professional advisers: In individual instances, we may share your Personal Data with professional advisers acting as service providers, processors, or joint controllers - including lawyers, bankers, auditors, and insurers who provide consultancy, banking, legal, insurance and accounting services, and to the extent we are legally obliged to share or have a legitimate interest in sharing your Personal Data;

Third parties involved in a corporate transaction: If we are involved in a merger, reorganization, dissolution or other fundamental corporate change, or sell a website or business unit, or if all or a portion of our business, assets or stock are acquired by a third party. In accordance with applicable laws, we will use reasonable efforts to notify you of any transfer of Personal Data to an unaffiliated third party;

Third party accounts: In relation to Dabble, if you connect to your third party accounts through our products, we will use that information to authenticate you, enumerate the data sources available to you, download any data you request us to, and download and refresh authentication tokens or persist authentication information such as user names and passwords as necessary to continue to connect to these data; and

Public authorities: With public and government authorities, to the extent we are compelled to disclose Personal Data to comply with our legal obligations.

We may also share aggregated Usage Data with Dabble’s service providers for the purpose of helping Dabble in such analysis and improvements. Additionally, Dabble may share Usage Data on an aggregate basis in the normal course of operating our business; for example, we may share information publicly to show trends about the general use of our services.

 

Anyone using our communities, forums, blogs, or chat rooms on our websites may read any Personal Data or other information you choose to submit and post.

7. International transfer of Personal Data

Your Personal Data may be collected, transferred to and stored by us in the United States and by our affiliates and third-parties disclosed in Section 6, above, that are based in other countries.

 

Therefore, your Personal Data may be processed outside your country or jurisdiction, including in places that are not subject to an adequacy decision by the European Commission or your local legislature or regulator, and that may not provide for the same level of data protection. We ensure that the recipient of your Personal Data offers an adequate level of protection and security, for instance by entering into the appropriate back-to-back agreements and, if required, standard contractual clauses or an alternative mechanism for the transfer of data as approved by the European Commission (Art. 46 GDPR) or other applicable regulators or legislators. Where required by applicable law, we will only share, transfer or store your Personal Data outside of your jurisdiction with your prior consent.

 

8. Children

Our websites and services are not directed at children. We do not knowingly collect Personal Data from children under the age of 13. We do not knowingly collect Personal Data for children between 13-18 unless we have obtained consent from a parent or guardian or such collection is subject to a separate agreement with us or the visit by a child is unsolicited or incidental. If you believe we have mistakenly or unintentionally collected Personal Data of a minor without appropriate consent please contact us by using the information in Section 13 below and we will take steps to delete their Personal Data from our systems.

9. How long do we keep your Personal Data?

We may retain your Personal Data for a period of time consistent with the original purpose of collection (see Section 5 above) or as long as required to fulfill our legal obligations. We determine the appropriate retention period for Personal Data on the basis of the amount, nature, and sensitivity of the Personal Data being processed, the potential risk of harm from unauthorized use or disclosure of the Personal Data, whether we can achieve the purposes of the processing through other means, and on the basis of applicable legal requirements (such as applicable statutes of limitation).

 

After expiry of the applicable retention periods, your Personal Data will be deleted. If there is any data that we are unable, for technical reasons, to delete entirely from our systems, we will implement appropriate measures to prevent any further use of such data.

10. Your rights relating to your Personal Data

10.1 Your rights

 

You may have certain rights relating to your Personal Data, subject to local data protection laws. Depending on the applicable laws these rights may include the right to:

 

Access your Personal Data held by us;

Know more about how we process your Personal Data;

Rectify inaccurate Personal Data and, taking into account the purpose of processing the Personal Data, ensure it is complete;

Erase or delete your Personal Data;

Restrict our processing of your Personal Data;

Transfer your Personal Data to another controller, to the extent possible;

Object to any processing of your Personal Data;

Opt out of certain disclosures of your Personal Data to third parties;

Know what categories of Personal Data are shared for delivering advertisements on non-Dabble websites, applications, and services and the categories of recipients of such Personal Data;

Opt out of the sharing of your Personal Data for delivering advertisements on non-Dabble websites, applications, and services;

If you’re under the age of 16, or such other applicable age of consent for privacy purposes in relevant individual jurisdictions, opt in to certain disclosures of your Personal Data to third parties; 

Not be subject to a decision based solely on automated processing, including profiling, which produces legal effects ("Automated Decision-Making");

Withdraw your consent at any time (to the extent we base processing on consent), without affecting the lawfulness of the processing based on such consent before its withdrawal; and

Not be discriminated against for exercising your rights as described above.

 

 

Where we process your Personal Data for direct marketing purposes or share it with third parties for their own direct marketing purposes, you can exercise your right to object at any time to such processing without having to provide any specific reason for such objection.

 

Please note that Automated Decision-Making currently does not take place on our websites or in our services.

 

 

 

10.2 How to exercise your rights

 

To exercise your rights, please contact us by using the information in Section 13 below. Your Personal Data may be processed in responding to these rights. We try to respond to all legitimate requests within one month unless otherwise required by law, and will contact you if we need additional information from you in order to honor your request or verify your identity. Occasionally it may take us longer than a month, taking into account the complexity and number of requests we receive. If you are an employee of a Dabble customer, we recommend you contact your employer’s system administrator for assistance in correcting or updating your information.

 

Some registered users may update their user settings, profiles, organization settings and event registrations by logging into their accounts and editing their settings or profiles.

 

To update your billing information, discontinue your account or request return or deletion of your Personal Data and other information associated with your account, please contact us by using the information in Section 13 below.

 

10.3 Your rights relating to customer data

 

As described above, we may also process Personal Data submitted by or for a customer to our products and services. To this end, if not stated otherwise in this Privacy Statement or in a separate disclosure, we process such Personal Data as a processor on behalf of our customer (and its affiliates) who is the controller of the Personal Data (see Section 1 above). We are not responsible for and have no control over the privacy and data security practices of our customers, which may differ from those explained in this Privacy Statement. If your data has been submitted to us in our role as a processor by or on behalf of a Dabble customer and you wish to exercise any rights you may have under applicable data protection laws, please inquire with them directly. Because we may only access a customer’s data upon their instructions, if you wish to make your request directly to us, please provide us the name of the Dabble customer who submitted your data to us. We will refer your request to that customer, and will support them as needed in responding to your request within a reasonable timeframe.

 

10.4 Your preferences for email and SMS marketing communications

 

If we process your Personal Data for the purpose of sending you marketing communications, you may manage your receipt of marketing and non-transactional communications from Dabble by clicking on the “unsubscribe” link located on the bottom of Dabble marketing emails, by replying or texting ‘STOP’ if you receive Dabble SMS communications, or by unsubscribing here. Please note that, notwithstanding the above, you will continue to receive marketing and non-transactional communications from CMO Club unless you manage your receipt of such communications by clicking on the “unsubscribe” link located on the bottom of CMO Club’s marketing emails.

 

You may also turn off push notifications on Dabble apps on your device, or unsubscribe by contacting us using the information in the “Contacting us” section, below.

 

Please note that opting out of marketing communications does not opt you out of receiving important business communications related to your current relationship with us, such as communications about your subscriptions or event registrations, service announcements or security information.

 

10.5 Your preferences for telemarketing communications

 

If you want your phone number to be added to our internal Do-Not-Call telemarketing register, please contact us by using the information in Section 13 below. Please include your first name, last name, company and the phone number you wish to add to our Do-Not-Call register.

 

Alternatively, you can always let us know during a telemarketing call that you do not want to be called again for marketing purposes.

 

11. How we secure your Personal Data

We take appropriate precautions including organizational, technical, and physical measures to help safeguard against accidental or unlawful destruction, loss, alteration, and unauthorized disclosure of, or access to, the Personal Data we process or use.

 

While we follow generally accepted standards to protect Personal Data, no method of storage or transmission is 100% secure. You are solely responsible for protecting your password, limiting access to your devices and signing out of websites after your sessions. If you have any questions about the security of our websites, please contact us by using the information in Section 13 below.

 

12. Changes to this Privacy Statement

We will update this Privacy Statement from time to time to reflect changes in our practices, technologies, legal requirements, and other factors. If we do, we will update the “effective date” at the top. If we make a material update, we may provide you with notice prior to the update taking effect, such as by posting a notice on our website or by contacting you directly, or where required under applicable law and feasible, seek your consent to these changes.

 

We encourage you to periodically review this Privacy Statement to stay informed about our collection, processing and sharing of your Personal Data.

15. Additional Disclosures for California Residents

The California Consumer Privacy Act (as amended by the California Privacy Rights Act) requires businesses to disclose whether they sell or share Personal Data. As a business covered by the CCPA, we do not sell Personal Data.  We may share Personal Data (in the form of identifiers and internet activity information) with third party advertisers for purposes of targeting advertisements on non-Dabble websites, applications and services. In addition, we may allow third parties to collect Personal Data from our sites or services if those third parties are authorized service providers who have agreed to our contractual limitations as to their retention, use, and disclosure of such Personal Data, or if you use Dabble sites or services to interact with third parties or direct us to disclose your Personal Data to third parties.

 

California law requires that we detail the categories of Personal Data that we disclose for certain “business purposes,” such as to service providers that assist us with securing our services or marketing our products, and to such other entities as described in Sections 5 and 6 of this Privacy Statement. We disclose the following categories of Personal Data for our business purposes:
